Audit service domain name trademark cease and desist parking page

The second step of the DomainRecovery.com service is a pre-litigation effort relying on your existing rights to the name. This service includes the drafting and delivery of cease and desists letters, not only to the squatter but also to every technical intermediary providing service attached to this service for this registration.

As part of this step our team will attempt to shutdown the website pointed by the domain name you wish to recover.

If the mediation is successful DomainRecovery.com will handle the escrowing and transfer of the domain name to your benefit.

If the squatter does not wish to surrender the domain at the end of this step, you still have options.

As part of the Mediation process, DomainRecovery.com will perform the following actions:

Cease-and-desist

This service includes the drafting and serving of cease and desist letters by registered mails to the cybersquatter. The whole process will happen within a 15 days period during which the initial letter and two subsequent reminders shall be sent to the registrant of the name.

To ensure the efficiency of the process, three emails and/or faxes will also be sent to the holder of the name during the same 15 days period.

On top of those written notifications, our team will also attempt to contact the domain name holder on the phone to convince them of the legal issues involved with this infringing registration.

Reaching-out to third-parties

In order to compel the domain name holder to comply with our Cease and Desist letter, our team will also notify:

the company hosting the website pointed to by the domain name in order to have this site shut down.

the registrar managing the domain name in order to ensure that our notifications have reached the cybersquatter

the registry responsible for the zone in which the domain name is registered.

If applicable we will also notify the auction provider whose platform the domain name is referenced on in order to prevent the cybersquatter from selling the domain name.

When the mediation is successful

Our team will draft the relevant transfer agreement and proceed to the transmission of the domain name to your benefit.

We will ensure a continuous monitoring of the transfer.

If the squatter refuses to surrender:

DomainRecovery.com will provide you with detailed reports that will help you building a case against the squatter and will recommend the most effective process to regain control of your domain:

either initiate a negotiation process, or

initiate an Alternative Dispute Resolution Process (i.e UDRP)

initiate a judiciary procedure before the competent court of law.
